Instruction Dilapidations - break clause advice

Our client, Brixton plc, leased a 12,000sq ft warehouse to a large software company.  The tenant exercised a break clause in their lease and Brixton plc instructed Malcolm Hollis to prepare and serve schedules of dilapidations and

to settle the claim prior to the break date. 

This should have given a 10 month time-frame, however, the tenant notified us that they needed to surrender the lease and settle any claim before their year end - which was only two weeks away, presenting us with an extraordinarily tight timescale.

Within these two weeks we undertook our inspection and negotiated a settlement with the tenant’s surveyor.  The settlement was agreed at £300,000 which was in conjunction with an overall surrender of £646,220.
